Appeals and Post-Conviction — What Do They Mean in Connecticut?

A post-conviction refers to the legal process after a criminal trial results in a defendant's conviction or when the defendant decides to accept a plea of no-contest or a guilty plea. After the conviction, the court will proceed with sentencing the defendant. If the defendant receives a guilty verdict, they can challenge this conviction.

On the other hand, an appeal is when you ask a higher court to review a decision made by a judge in a lower court. The higher court will look at the "record" from the trial court, including evidence, documents, and transcripts, and decide if the judge made any mistakes of law. In an appeal, the higher court cannot review any new evidence. Instead, they will only look at what was done and said in the trial court.

The Legal Process

Typically, if you believe there was an error in the court process that caused your conviction, you will have a right to appeal the decision. However, this appeal needs to be done as soon as possible after your criminal conviction and punishment are imposed. The purpose of this appeal will be to refute the conviction that the judge imposed. But it is important to remember that you cannot appeal this conviction until the judge imposes a sentence.
